1. Age Requirement: You must be at least 13 years old to use the Service, unless your parent or legal guardian has provided verifiable consent.

2. Acceptance of Terms: By creating an Account or using the Service, you represent that you meet the above eligibility requirements and agree to comply with these Terms.

1. Account Creation: To access certain features, you may be required to create an Account. You agree to provide accurate, current, and complete information during registration.

2. Security: You are responsible for maintaining the confidentiality of your login credentials. Notify BeeWise immediately if you suspect unauthorized use of your Account.

3. Multiple Accounts: Unless expressly permitted by BeeWise, you may not create multiple Accounts for the same individual or entity.

4. Termination: We reserve the right to suspend or terminate your Account at our discretion for any violation of these Terms or suspected fraudulent behavior.

5.1. Course Materials: BeeWise provides educational materials, videos, quizzes, assignments, and other resources (“Course Materials”). These materials are for personal, non-commercial use unless expressly agreed otherwise.

5.2 User-Generated Content:

1. Users may submit assignments, comments, or other content (“User-Generated Content”).

2. By submitting content, you grant BeeWise a worldwide, royalty-free, perpetual, irrevocable, and sublicensablelicense to use, reproduce, distribute, modify, and display such content for educational and business purposes.

3. Users are solely responsible for ensuring their content does not violate third-party rights or applicable laws.

6.1. Fees and Billing: Certain courses and features require payment. Fees and payment terms will be displayed at checkout. By making a purchase, you agree to pay all applicable charges and any related taxes using your selected payment method.

6.2. Payment Methods: We accept payments via credit cards, debit cards, and other authorized payment methods as indicated on the Website. You confirm that you are authorized to use the selected payment method.

6.3 Refund Policy:

Trial Period

BeeWise offers a 3-day free trial to allow users to explore the platform before making a payment. After this trial period ends, all payments are final and non-refundable, except in the following cases:

Single-Course Purchases

Refunds may be granted if:

1. The user has accessed less than 20% of the course content and requests a refund within 3 days of payment.

2. The course is permanently removed from BeeWise within 30 days of purchase.

3. A significant technical failure prevents access, and BeeWise support is unable to resolve the issue.

Subscriptions

1. Subscriptions automatically renew unless canceled at least 24 hours before the next billing cycle.

2. Users are responsible for managing their subscriptions via their account settings.

3. No refunds are provided for failure to cancel before renewal.

4. If BeeWise discontinues a subscription-based course, affected users may receive alternative content or a prorated refund, at BeeWise’s discretion.

6.4 Chargebacks: Users agree that all payments made to BeeWise are final and non-reversible, except where explicitly permitted under our Refund Policy (Section 6.3). By purchasing a course or subscription, you acknowledge and agree to the following chargeback conditions:

1. No Unauthorized Chargebacks:

• Users must contact BeeWise’s support team at edu@beewise.ee before initiating any chargeback request with their payment provider.
• Unauthorized or unjustified chargebacks will be considered fraudulent activity and a breach of this Agreement.

2. Liability for Fraudulent Chargebacks:

• If a user disputes a legitimate charge after receiving access to a course or service, BeeWise reserves the right to provide the payment provider with proof of access, course completion, or any relevant user activity to contest the chargeback.
• Users who initiate an unjustified chargeback may be held responsible for the disputed amount, any additional fees imposed by financial institutions, and legal recovery costs incurred by BeeWise.

3. Account Suspension & Legal Consequences:

• If a chargeback is initiated without prior communication and does not comply with our Refund Policy, BeeWise may immediately suspend or permanently terminate the user’s account, including access to all purchased courses and future services.
• BeeWise reserves the right to report fraudulent chargebacks to relevant authorities, credit agencies, and payment processors, which may affect the user’s ability to make future online transactions.

4. Dispute Resolution for Chargebacks:

• In cases of disputed transactions, BeeWise will provide all necessary documentation (including login records, course access data, and refund eligibility status) to the payment provider.
• If a user falsely claims unauthorized transactions or non-receipt of services while actively using the platform, BeeWise may take legal action to recover lost funds and associated costs.

By using BeeWise’s services, you explicitly agree to this chargeback policy and acknowledge that unjustified chargebacks constitute fraudulent activity.

You agree not to:

1. Violate Laws: Use the Service for any purpose that is unlawful or prohibited by these Terms or any applicable law.
2. Infringe Rights: Upload, post, or transmit any content that violates any third party’s intellectual property or privacy rights.
3. Harass or Harm: Engage in harmful, harassing, defamatory, or abusive behavior toward others.
4. Security Interference: Attempt to probe, scan, or test the vulnerability of the Service or breach any security or authentication measures.
5. Reverse Engineer: Decompile, reverse engineer, or otherwise attempt to obtain the source code of the Service.

BeeWise reserves the right to investigate and prosecute violations of any of the above and may involve law enforcement authorities where appropriate.

8.1. Ownership: BeeWise (or its licensors) retains all rights, title, and interest in and to the Service, including all software, code, design, and associated intellectual property.

8.2. License: Subject to these Terms, BeeWise grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, educational purposes.

8.3. User-Generated Content: By submitting User-Generated Content, you grant BeeWise a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such content in connection with the Service and BeeWise’s business.

To the maximum extent permitted by law, BeeWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; or (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party.

You agree to defend, indemnify, and hold harmless BeeWise, its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (d) any content you submit or make available through the Service. This defense and indemnification obligation will survive these Terms and your use of the Service.

11.1. By BeeWise: We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, if you violate these Terms, fail to pay fees, engage in fraudulent activity, or for any other reason that we determine to be harmful to BeeWise or other users.

11.2. By You: You may terminate your account at any time by contacting our support team at info@beewise.ee.

11.3. Effect of Termination: Upon termination:

• Your right to access the Service will immediately cease.
• Any outstanding payments owed to BeeWise remain due.
• We may delete your account data, except where retention is required by law.

11.4. Survival of Terms: Sections related to intellectual property, confidentiality, indemnification, limitations of liability, dispute resolution, and chargebacks shall survive termination.

12.1. If a course is permanently closed by BeeWise due to business reasons or other strategic considerations, we will notify affected users.

12.2. Users who have purchased lifetime access to a course will be provided with either access to alternative content or a prorated refund, at BeeWise’s sole discretion.

12.3. Refund requests must be made within 7 days of purchase, as outlined in our Refund Policy (Section 6.3). After this period, refunds will not be granted except in cases where the course is removed within 30 days of purchase.

13.1. Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Estonia.

13.2. Arbitration Agreement: In the event of any dispute, claim, or controversy arising out of or relating to these Terms, you agree to first contact BeeWise to resolve the issue amicably. If no resolution is reached, the dispute shall be exclusively settled by binding arbitration in Tallinn, Estonia.

13.3. Class Action Waiver: You agree that you may only bring claims against BeeWise in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you agree to the terms of the Privacy Policy.

15.1. We may update these Terms from time to time. The latest version will always be available on our website, and significant changes will be communicated via email or through a notice on our website (news section).

15.2. Continued use of the Service after the updated Terms take effect constitutes acceptance of the revised Terms.

16.1. Entire Agreement: These Terms, together with our Privacy Policy and any other referenced agreements, constitute the entire agreement between you and BeeWise.

16.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3. Force Majeure: Neither Party shall be held liable for failure to perform obligations due to circumstances beyond reasonable control (e.g., natural disasters, war, cyberattacks, government restrictions).

16.4. Electronic Signatures: By using the Service, you agree that digital acceptance of these Terms constitutes a legally binding agreement, equivalent to a physical signature.
